These Terms and Conditions of Sale govern all sales made on the website
www.atmospheredailleurs.com<\/a>, to both private individuals and professionals.<\/p>\n\n\n\n

Any order implies full and unconditional acceptance of these Terms and Conditions.<\/p>\n\n\n\n

The products offered are those presented on the website, subject to availability.<\/p>\n\n\n\n

Descriptions and photographs are provided with the utmost care. However, variations (color, material, rendering) may occur and shall not be considered defects.<\/p>\n\n\n\n

In the event of product unavailability after an order has been placed, the Customer will be informed and may choose between a refund or a postponed delivery.<\/p>\n\n\n\n

    Delivery costs are specified before order confirmation.<\/p>\n\n\n\n

    Applicable prices are those in force at the time of the order.<\/p>\n\n\n\n

    6. Orders<\/strong><\/h2>\n\n\n\n

    An order is validated after:<\/p>\n\n\n\n

    • product selection<\/li>\n\n\n\n
    • entry of customer details<\/li>\n\n\n\n
    • acceptance of the Terms and Conditions<\/li>\n\n\n\n
    • payment<\/li>\n<\/ul>\n\n\n\n

      A confirmation email is sent.<\/p>\n\n\n\n

      The Company reserves the right to refuse any order in case of a prior dispute.<\/p>\n\n\n\n

      7. Payment<\/strong><\/h2>\n\n\n\n

      Payment is made online by credit card or any other method offered on the website.<\/p>\n\n\n\n

      Transactions are secured.<\/p>\n\n\n\n

      8. Invoicing<\/strong><\/h2>\n\n\n\n

      An invoice is sent by email or made available in the customer account.<\/p>\n\n\n\n

      9. Delivery \u2013 Receipt<\/strong><\/h2>\n\n\n\n

      Products are delivered to the address provided by the Customer.<\/p>\n\n\n\n

      Delivery times are indicative.<\/p>\n\n\n\n

      Products remain at the seller\u2019s risk until they are delivered to the consumer, in accordance with applicable law.<\/p>\n\n\n\n

      For professional customers, products travel at the Customer\u2019s risk from the moment they are handed over to the carrier.<\/p>\n\n\n\n

      In the event of damage (damaged parcel, broken or missing items), the Customer must:<\/p>\n\n\n\n

        \n
      • make precise reservations on the delivery note<\/li>\n\n\n\n
      • confirm these reservations with the carrier under the conditions set out in Article L133-3 of the French Commercial Code<\/li>\n\n\n\n
      • inform the Company as soon as possible at: info@atmospheredailleurs.com<\/li>\n<\/ul>\n\n\n\n

        In the absence of reservations within 48 hours of delivery, the products shall be deemed compliant.<\/p>\n\n\n\n

        In accordance with Article L216-4 of the French Consumer Code, risk is transferred to the consumer when they take physical possession of the goods.<\/p>\n\n\n\n

        For professional customers, risk is transferred upon handover to the carrier.<\/p>\n\n\n\n

        \n\n\n\n

        10. Right of Withdrawal (Consumers)<\/strong><\/h2>\n\n\n\n

        In accordance with Articles L221-18 et seq. of the French Consumer Code, private customers have a period of 14 days<\/strong> from receipt of the goods to exercise their right of withdrawal.<\/p>\n\n\n\n

          Returns<\/strong><\/h3>\n\n\n\n

          • in perfect condition<\/li>\n\n\n\n

            Any damaged, incomplete, or used product will not be refunded.<\/p>\n\n\n\n

            Return costs are borne by the Customer.<\/p>\n\n\n\n

            \n\n\n\n

            Refund<\/strong><\/h3>\n\n\n\n

            In accordance with Article L221-24 of the French Consumer Code, reimbursement will be made within 14 days after receipt and validation of the returned products.<\/p>\n\n\n\n

            \n\n\n\n

            Exceptions<\/strong><\/h3>\n\n\n\n

            In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:<\/p>\n\n\n\n

            • customized products<\/li>\n\n\n\n
            • products made to the Customer\u2019s specifications<\/li>\n<\/ul>\n\n\n\n

              11. Transfer of Ownership and Risk<\/strong><\/h2>\n\n\n\n

              Ownership is transferred upon full payment.<\/p>\n\n\n\n

              In accordance with Article L216-4 of the French Consumer Code, risk is transferred upon receipt of the goods by the Customer.<\/p>\n\n\n\n

              12. Legal Guarantees<\/strong><\/h2>\n\n\n\n

              Products benefit from applicable legal guarantees.<\/p>\n\n\n\n

              In accordance with Article L217-3 of the French Consumer Code, the seller delivers goods in conformity with the contract.<\/p>\n\n\n\n

              In accordance with Article 1641 of the French Civil Code, the seller is liable for hidden defects.<\/p>\n\n\n\n

              In case of defective or non-compliant products, the Customer may contact the Company to agree on an appropriate solution.<\/p>\n\n\n\n

              13. Liability<\/strong><\/h2>\n\n\n\n

              The Company shall not be held liable for:<\/p>\n\n\n\n

              • improper use of products<\/li>\n\n\n\n
              • website interruptions<\/li>\n\n\n\n
              • issues related to the Internet network<\/li>\n\n\n\n
              • force majeure events<\/li>\n<\/ul>\n\n\n\n

                14. Intellectual Property<\/strong><\/h2>\n\n\n\n

                All elements of the website are protected. Photos are subject to copyright.<\/p>\n\n\n\n

                No Right of Withdrawal<\/strong><\/h3>\n\n\n\n

                The right of withdrawal does not apply to professional customers.<\/p>\n\n\n\n

                Payment<\/strong><\/h3>\n\n\n\n

                Unless otherwise agreed, invoices are payable immediately.<\/p>\n\n\n\n

                Late payment automatically results in:<\/p>\n\n\n\n

                • late payment penalties at a rate of 1.5% per month<\/strong> (i.e. 18% annually), without prior notice<\/li>\n\n\n\n
                • a fixed compensation of \u20ac40 for recovery costs<\/strong>, in accordance with Article L441-10 of the French Commercial Code<\/li>\n<\/ul>\n\n\n\n

                  Retention of Title<\/strong><\/h3>\n\n\n\n

                  Products remain the property of the Company until full payment.<\/p>\n\n\n\n

                  These Terms and Conditions are governed by French law.<\/p>\n\n\n\n

                  An amicable solution will be sought before any legal action.<\/p>\n\n\n\n

                  19. Sales within and outside the European Union<\/strong><\/h2>\n\n\n\n

                  Products may be delivered in France, within the European Union, and internationally.<\/p>\n\n\n\n

                  For deliveries within the EU:<\/p>\n\n\n\n

                  • prices are expressed in euros<\/li>\n\n\n\n
                  • French VAT applies, except in specific cases (e.g. valid intra-community VAT number)<\/li>\n\n\n\n
                  • no customs duties apply<\/li>\n<\/ul>\n\n\n\n

                    Outside the European Union<\/strong><\/h3>\n\n\n\n

                    For deliveries outside the EU:<\/p>\n\n\n\n

                    • prices may be invoiced excluding VAT<\/li>\n\n\n\n
                    • customs duties, local taxes, or import fees may apply<\/li>\n<\/ul>\n\n\n\n

                      These charges are borne exclusively by the Customer.<\/p>\n\n\n\n

                      The Company shall not be held liable for:<\/p>\n\n\n\n

                      • customs duties<\/li>\n\n\n\n
                      • delays due to customs procedures<\/li>\n\n\n\n
                      • refusal of customs clearance<\/li>\n<\/ul>\n\n\n\n
                        \n\n\n\n

                        Customer Responsibility<\/strong><\/h3>\n\n\n\n
