2. Purpose

These Terms and Conditions of Sale govern all sales made on the website
www.atmospheredailleurs.com, to both private individuals and professionals.

Any order implies full and unconditional acceptance of these Terms and Conditions.


3. Products

The products offered are those presented on the website, subject to availability.

Descriptions and photographs are provided with the utmost care. However, variations (color, material, rendering) may occur and shall not be considered defects.


4. Availability

In the event of product unavailability after an order has been placed, the Customer will be informed and may choose between a refund or a postponed delivery.


5. Prices

Prices are expressed in euros (€):

  • Including VAT for private customers
  • Excluding VAT for professionals or deliveries outside the European Union

Delivery costs are specified before order confirmation.

Applicable prices are those in force at the time of the order.


6. Orders

An order is validated after:

  • product selection
  • entry of customer details
  • acceptance of the Terms and Conditions
  • payment

A confirmation email is sent.

The Company reserves the right to refuse any order in case of a prior dispute.


7. Payment

Payment is made online by credit card or any other method offered on the website.

Transactions are secured.


8. Invoicing

An invoice is sent by email or made available in the customer account.


9. Delivery – Receipt

Products are delivered to the address provided by the Customer.

Delivery times are indicative.

Products remain at the seller’s risk until they are delivered to the consumer, in accordance with applicable law.

For professional customers, products travel at the Customer’s risk from the moment they are handed over to the carrier.

In the event of damage (damaged parcel, broken or missing items), the Customer must:

  • make precise reservations on the delivery note
  • confirm these reservations with the carrier under the conditions set out in Article L133-3 of the French Commercial Code
  • inform the Company as soon as possible at: info@atmospheredailleurs.com

In the absence of reservations within 48 hours of delivery, the products shall be deemed compliant.

In accordance with Article L216-4 of the French Consumer Code, risk is transferred to the consumer when they take physical possession of the goods.

For professional customers, risk is transferred upon handover to the carrier.


10. Right of Withdrawal (Consumers)

In accordance with Articles L221-18 et seq. of the French Consumer Code, private customers have a period of 14 days from receipt of the goods to exercise their right of withdrawal.

Returns

Products must be returned to:

  • within 14 days
  • in perfect condition
  • in original packaging

Any damaged, incomplete, or used product will not be refunded.

Return costs are borne by the Customer.


Refund

In accordance with Article L221-24 of the French Consumer Code, reimbursement will be made within 14 days after receipt and validation of the returned products.


Exceptions

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • customized products
  • products made to the Customer’s specifications

11. Transfer of Ownership and Risk

Ownership is transferred upon full payment.

In accordance with Article L216-4 of the French Consumer Code, risk is transferred upon receipt of the goods by the Customer.


12. Legal Guarantees

Products benefit from applicable legal guarantees.

In accordance with Article L217-3 of the French Consumer Code, the seller delivers goods in conformity with the contract.

In accordance with Article 1641 of the French Civil Code, the seller is liable for hidden defects.

In case of defective or non-compliant products, the Customer may contact the Company to agree on an appropriate solution.


13. Liability

The Company shall not be held liable for:

  • improper use of products
  • website interruptions
  • issues related to the Internet network
  • force majeure events

14. Intellectual Property

All elements of the website are protected. Photos are subject to copyright.

Any reproduction or use without authorization is prohibited.


15. Personal Data

Personal data collected is necessary for order processing and customer relationship management.

It is processed in accordance with applicable data protection regulations.

The Customer has the right to access, rectify, delete and object.

16. Archiving

Contractual documents are stored in accordance with legal obligations.


17. Provisions Applicable to Professionals

No Right of Withdrawal

The right of withdrawal does not apply to professional customers.


Payment

Unless otherwise agreed, invoices are payable immediately.

Late payment automatically results in:

  • late payment penalties at a rate of 1.5% per month (i.e. 18% annually), without prior notice
  • a fixed compensation of €40 for recovery costs, in accordance with Article L441-10 of the French Commercial Code

Retention of Title

Products remain the property of the Company until full payment.


Liability

Liability is limited to direct damages.


Disputes

Disputes between professionals fall under the jurisdiction of the courts where the Company’s registered office is located.


18. Applicable Law

These Terms and Conditions are governed by French law.

An amicable solution will be sought before any legal action.


19. Sales within and outside the European Union

Products may be delivered in France, within the European Union, and internationally.


European Union

For deliveries within the EU:

  • prices are expressed in euros
  • French VAT applies, except in specific cases (e.g. valid intra-community VAT number)
  • no customs duties apply

Outside the European Union

For deliveries outside the EU:

  • prices may be invoiced excluding VAT
  • customs duties, local taxes, or import fees may apply

These charges are borne exclusively by the Customer.

The Company shall not be held liable for:

  • customs duties
  • delays due to customs procedures
  • refusal of customs clearance

Customer Responsibility

The Customer is responsible for import procedures and is advised to check local regulations.
